Ideally, if you have been charged with a crime, we review your case and work with the DA to get the charges dismissed. If that is not possible, we will try everything to ensure that the consequences for you and your future are minimized. This often means plea bargains for reduced sentences or probation. If a conviction is impossible to escape, we will work to get it expunged later.
This applies whether you have been charged with a violent crime, fraud, another felony or a lesser offence like a misdemeanor DUI. If a collaborative approach is unsuccessful, we will defend you aggressively in court.
No matter the seriousness of your alleged criminal offence, you are entitled to a defence. Unfortunately, many people are wrongfully convicted and imprisoned and we will fight to ensure that you are not the next. We have secured case dismissals even for convicted felons with firearm charges and assaults with deadly weapons. Sometimes, there are multiple charges against our clients – and we work to ensure that the charges are either terminated before they ever make it to trial or reduced.
If you are convicted of a crime in state or federal court (either by pleading guilty or being found guilty at trial), you have a right to appeal either the conviction or the sentence. However, criminal appeal cases with the California Court of Appeal require specialist knowledge and experience. To be eligible for appeal, you need to demonstrate that a legal error was made in your case.
It is easy to waste time and build false hope, as the appellate process is complex. It helps to be able to quickly assess whether cases have a good chance of success. Matthew Barhoma has gained success in even the most challenging of appeal cases – including securing multiple SB1437 successes. These are cases where people already convicted of murder have successfully petitioned the court to have their convictions overturned.
